Mary M. (Peggy) Brockington

Adjunct Faculty

In her education practice, Peggy represents colleges, universities, public and private schools and charter schools in matters involving employment law, disability law, faculty misconduct, FERPA, Clery Act, student discipline, teacher discipline, tenure, regulatory compliance, accreditation, charter applications, federal funding, governance and risk management. A former special education teacher, Peggy is a regular speaker on education-related topics and is Vice-Chair/Immediate Past Chair of the School and College Law Section of the State Bar of Georgia.

In employment matters, Peggy defends employers before administrative agencies, and in state and federal courts through all stages of litigation, including trial, appeal, mediation and arbitration. She has successfully defended numerous discrimination cases arising under Title VII, the Americans with Disabilities Act, Pregnancy Discrimination Act, Age Discrimination in Employment Act, Family and Medical Leave Act and Fair Labor Standards Act, as well as a variety of employment-related tort cases. She also provides advice, counseling and training to employers designed to minimize their exposure to claims of discrimination, harassment, retaliation, wrongful termination, breach of contract and torts.

Peggy's litigation practice includes jury trials, bench trials, motions practice, appeals, mediation and arbitration. She has experience in a wide variety of cases involving business torts, personal injury claims and complex commercial disputes, including antitrust, premises liability, tortious interference, slander and libel, civil rights, constitutional law, professional negligence, educational malpractice, false arrest and imprisonment, breach of contract, conversion, nuisance, negligent hiring and retention, restrictive covenants, real estate contracts, fraud, misrepresentation, assault, battery, wrongful death, breach of fiduciary duty, intentional infliction of emotional distress and negligence.

Peggy has been recognized as a Georgia Super Lawyer for the years 2005 through 2009, and was named by Georgia Trend Magazine as one of the state's "2008 Legal Elite: Georgia's Most Effective Lawyers." She is a Master in both the Bleckley Inn of Court and the Lamar Inn of Court, and served on the Graduate Leadership Council of the Georgia State University College of Law for twenty years. She taught litigation as an adjunct professor at the Georgia State University College of Law for a number of years and frequently serves as a faculty member at the Kessler-Eidson Program for Trial Techniques at Emory University and the Georgia Trial Skills Clinic at the University of Georgia.

Peggy is a member of the State Bar of Georgia (School and College Law Section (Vice Chair/Immediate Past Chair), Labor and Employment Section, and Litigation Section), American Bar Association (Labor and Employment Section, Litigation Section, Education Law Section), Atlanta Bar Association (Secretary-Treasurer of Labor and Employment Section, Litigation Section), National Association of College and University Attorneys (former member of Program Committee), Advisory Board of the Georgia Association of Women Lawyers and Lawyers Club of Atlanta. She has served as a member of the Judicial Selection and Tenure Committee of the Atlanta Bar Association, and is a member of Midtown Alliance and a graduate of the Midtown Leadership Program. Peggy coached a high school mock trial team for more than a dozen years, and has served as president of the Northridge Forest Neighborhood Association. Peggy received her B.S., with distinction, from the University of Kansas in 1973, and her J.D., magna cum laude, from Georgia State University in 1986.

She is admitted to practice in the State and Superior Courts of the State of Georgia, Georgia Court of Appeals, Georgia Supreme Court, United States District Court for the Northern District of Georgia, United States District Court for the Middle District of Georgia, Eleventh Circuit Court of Appeals, Eighth Circuit Court of Appeals and United States Supreme Court.
